Terms of Service

These Terms of Service ("Terms") are an agreement between you and Three Floors Ventures LLC, which operates Pick Ya Fit ("Pick Ya Fit," "we," "us," or "our"), and they govern your use of the Pick Ya Fit mobile application, the website at pickyafit.com, and any related services (together, the "Services"). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

1. Who can use Pick Ya Fit

Pick Ya Fit is for people 13 years of age and older. You may not use the Services if you are under 13. If you are between 13 and 17, you may use the wardrobe, styling, and social features, but you may not buy, sell, or send messages on the Pick Ya Thrift marketplace — that part of the Services is limited to users 18 and older. By using the Services you confirm that you are at least 13 (and at least 18 to use the marketplace), or that you are the parent or legal guardian of a user aged 13 to 17 and consent to their use of the non-marketplace features. We ask for your date of birth when you sign up and block accounts that do not meet these ages.

2. Your account

You are responsible for the information you provide and for keeping your login credentials secure. Keep your account details accurate and up to date. You are responsible for activity that happens under your account. Tell us at [email protected] if you believe your account has been used without your permission.

3. Subscriptions, billing, and cancellation

Some features of Pick Ya Fit require a paid subscription. Subscriptions are billed through your app store account — the Apple App Store or Google Play — not directly by us, and are subject to that store's terms. Subscriptions renew automatically for the same period unless you cancel at least 24 hours before the end of the current period.

You manage and cancel your subscription in your app store account settings, not in the app. Deleting the app does not cancel a subscription. Payments are handled entirely by the app store; we do not receive or store your payment card details. Prices may change, and we will give notice of any change as required by the app store and applicable law. Refunds are handled under the policies of the app store you purchased through.

4. Your content

You keep ownership of the photographs, listings, and other content you upload ("Your Content"). By uploading Your Content, you give us a non-exclusive, worldwide, royalty-free license to store, display, and process it as needed to operate and provide the Services to you — for example, to catalog your wardrobe, build outfits, generate portraits, and show your listings to other users. This license ends when you delete the content or your account, except for copies retained in routine backups or as required by law.

You are responsible for Your Content. You confirm that you have the right to upload it and that it does not violate the law or anyone else's rights. Do not upload content that is illegal, infringing, sexually explicit, hateful, harassing, or that depicts other people without their permission.

5. Pick Ya Thrift is a listings board only

Pick Ya Thrift lets users list secondhand clothing and connect with one another. It is a listing and introduction board only. No transactions happen on Pick Ya Fit. We do not process payments, hold funds, set prices, arrange shipping or pickup, verify items or users, or take any part in what happens after two users connect.

Anything you arrange with another user — payment, meeting in person, delivery, condition of an item — is strictly between you and that user, and you do so at your own risk. We are not a party to those dealings and are not responsible for them, including for payment disputes, items that are not as described, no-shows, or anything that happens when users meet. Use good judgment, and meet in safe, public places. Buying, selling, and messaging on Pick Ya Thrift are limited to users 18 and older; browsing and sharing listings are open to all users 13 and older.

6. Acceptable use

When you use the Services, you agree not to:

We may suspend or terminate accounts that break these Terms or that we reasonably believe are being used to harm other users or the Services.

7. Messaging, reporting, and blocking

Messaging exists so users can coordinate about listings. You are responsible for what you send. You can report and block other users, and we may review reported conduct and act on it, including removing content or suspending accounts. We are not responsible for the content of messages between users.

Deleting a conversation removes it from your inbox only. The other person keeps their copy, and we keep a record of Pick Ya Thrift messages for safety and to review reports. These records are kept for 1 year after the last message in a conversation, or longer if they are tied to an open report or legal request. See our Privacy Policy for details.

8. Styling and AI features

Pick Ya Fit uses artificial intelligence to analyze photos, describe garments, suggest outfits, and generate portraits. These features rely on third-party AI providers, and their output may be inaccurate, incomplete, or not to your taste. Styling suggestions are suggestions, not professional, medical, or any other kind of expert advice. You decide what to wear and how to use the Services; we do not guarantee any particular result.

9. Our intellectual property

The Services — including the Pick Ya Fit and Pick Ya Thrift names, the app, the website, and their design and software (but not Your Content) — belong to us and are protected by law. We grant you a personal, limited, non-transferable license to use the Services for their intended purpose. You may not copy, resell, or create derivative works from the Services except as allowed by law.

10. Disclaimers

The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent allowed by law. We do not warrant that the Services will be uninterrupted, error-free, or secure, that outfit or styling suggestions will suit you, or that any listing, item, or user on Pick Ya Thrift is accurate, genuine, safe, or trustworthy.

11. Limitation of liability

To the fullest extent allowed by law, Pick Ya Fit will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from dealings between users, items bought or sold, messages, or your use of or inability to use the Services. To the extent we are found liable, our total liability to you will not exceed the greater of the amount you paid us in the twelve months before the claim or fifty U.S. dollars ($50). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

12. Indemnification

You agree to indemnify and hold Pick Ya Fit harmless from claims, damages, and expenses (including reasonable legal fees) arising out of your content, your use of the Services, your dealings with other users, or your breach of these Terms, to the extent allowed by law.

13. Termination

You may stop using the Services and delete your account at any time. We may suspend or end your access if you break these Terms or to protect the Services or other users. When your account ends, your right to use the Services ends; sections that by their nature should survive (such as content licenses for backups, disclaimers, limitation of liability, and indemnification) will survive.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will change the "Last updated" date above and, for material changes, provide notice within the app or on this page. Continuing to use the Services after a change means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-laws rules. You agree that any dispute not resolved informally will be handled in the state or federal courts located in New Jersey, to the extent allowed by law.
